Intellectual property

Protecting one’s ideas from the competition is as old as business itself. Today, the perception of intellectual property (IP) is rapidly changing: from ideas that require global protection to global assets that merit ‘intelligent’ exploitation. Once you start to view IP as an asset, your eyes open up to new opportunities. Think beyond patents: think trademarks, copyrights, images, designs, knowledge bases, CRM and other database based competencies, domain names and know-how. Our skill and experience focus on that precisely: the international management and structuring of assets.

Corporate royalty structures

How royalty structuring works;

A company owning the IP donates or sells it to a ‘controlled’ IP company. This is preferably done when the IP is still of little value. The IP company then licenses some or all of the rights for the use of the IP to an intermediary or agency company created in a jurisdiction offering tax benefits such as a tax treaty network, withholding tax exemption for royalty payments and other advantages.

The intermediary company sub-licenses this right to customers in various countries. This way the royalty fees are remitted to the intermediary company. Finally, the intermediary company remits the balance to the IP company.

Intertrust’s global footprint and network makes us a perfect partner to structure your IP.
